SERVICE TERMS

The domain of the Site belongs to  Cláudia Sofia Afonso Fernandes, named Cláudia Afonso, NIF: 199184933, with tax address at: Rua Ilha de Santa Maria, 184, Carcavelos, which is responsible for its exploration and operation management.

The use of the Site by third parties implies, from now on, the acceptance of these Terms and Conditions of Use (TCU) by its Users.

1- Access to the Site

Cláudia Afonso , as owner of the Site, may, at any time, prohibit third parties from accessing it, namely for updating or maintenance purposes. Additionally, Cláudia Afonso will have the right to close it at any time in the event of any circumstance that, in her opinion, justifies it. 

2- Intellectual Property Rights

Cláudia Afonso owns the copyright on all products in the store, images, drawings, graphics and other content that are available on the Site. 

Users are not authorized to reproduce, copy, alter, sell or use these elements.

3- Privacy and processing of personal data

The privacy of Site Users is a special concern for Cláudia Afonso. In this sense, we have approved a Privacy Policy which defines the general principles applicable to the collection and processing of personal data, which we will strictly comply with. It can be consulted here: Privacy Policy .

4- Changes to the TCU

Cláudia Afonso reserves the right to make the necessary changes to these TCU. Whenever this happens, they will be published on the Site, so it is advisable that Users of the Site consult it regularly.

SALE CONDITIONS
1\ Buying and selling
  1. The Products are presented on the Website with a description that allows the Buyer to know their essential characteristics and their price;
  2. The Buyer selects the Product(s) he intends to buy;
  3. The Purchaser confirms his choice of Product(s) and acknowledges and accepts these Terms and Conditions by means of a validation click;
  4. The Buyer receives an e-mail confirming the acceptance of his order. However, the purchase and sale agreement entered into between the Buyer and the Seller is subject to the resolutive condition of the availability of the Product.
  5. The Seller is informed by MKTPLACE that one or more Products that he has placed online have been the subject of an order;

RIGHT OF FREE TERMINATION OF CONTRACT

Framework: 

Pursuant to the legislation in force, the Buyer has a period of 14 (fourteen) days from receipt of the Product(s) ordered to express, to the aforementioned Seller, its intention to exercise the right of free resolution that assists you without payment of compensation and without the need to indicate the reason.

In case of exercise of the right of free withdrawal within the aforementioned period, only the price of the Product(s) purchased and the shipping costs will be refunded. Return costs are the responsibility of the Buyer.

Procedure: 

1- The Buyer exercises his right of free withdrawal directly from the Seller in question through the messaging tool placed at his disposal within the scope of the Service.

2- The Product(s) must be returned in its original and complete condition(s) (packaging, accessories, instruction manual, etc.) packaged in the same way as in the shipment, within 14 days of the date on which the Buyer informed the Seller that he intended to return the product.

The return of the Product(s) must be made to the following address: Galeria Cláudia Afonso, Fortaleza da Cidadela de Cascais, Av. Dom Carlos I, 2750-310 Cascais

3- Reimbursement for returned products is made by the Seller to the Buyer within the shortest possible period and within a period of 14 (fourteen) days from the date on which the product was received by the Seller.

EXTRAJUDICIAL RESOLUTION OF CONSUMPTION DISPUTES

Framework: 

In the event of a consumer dispute, defined in accordance with the provisions of Law No. 144/2015, of September 8, the consumer may resort to the competent alternative resolution entity for consumer disputes.

Procedure:

The consumer can opt for the European online dispute resolution platform available at https://webgate.ec.europa.eu/odr , or for the alternative resolution entity for consumer disputes in the place of his domicile. You can consult the updated list of all alternative consumer resolution entities available at https://www.consumidor.gov.pt/parceiros/sistema-de-defesa-do-consumidor/entidades-de-resolucao-alternativa-de- litigios-de-consumo.aspx

If there is no alternative dispute resolution entity(ies) under the terms above  referred to, the consumer may resort to the National Center for Information and Arbitration of Conflicts of Consumption, located in Lisbon, with the email address: cniacc@unl.pt and available at https://www.cniacc.pt/pt .
